HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34091 of 2018 ORDER:
1) Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in not issuing pattadar pass books and title deeds in favour of petitioner Nos.2 and 3 and not mutating their names in revenue records in respect of land in Survey Nos.376/C and 377/D, admeasuring Ac.1.26 guntas and Ac.0.06 guntas respectively, situated at Wanaparti village, Lingala Ghanapuram mandal, Jangaon District (erstwhile Warangal District), pursuant to the registered gift settlement deeds dated 12.10.2017, vide document Nos.8261 and 8262 of 2017, as illegal and arbitrary.
3) Learned counsel for the petitioners mainly submits that pursuant to the registered gift settlement deeds dated 12.10.2017, an application dated 25.10.2017, came to be made for mutation of the names of petitioner Nos.2 and 3 in the revenue records, but till today, neither any steps have been taken for mutating the names of petitioner Nos.2 and 3
nor any orders are passed by the Tahsildar on the said application.
4) Having regard to the above, if the application dated 25.10.2017 made by the petitioner for mutation of land referred to above is still pending consideration, the Tahildarrespondent No.4 shall deal with the same, in accordance with law, after examining all the concerned and pass appropriate orders thereon, in accordance with law, as early as possible, preferably within a period of three to five months from the date of receipt of a copy of the order. 5) Accordingly, the writ petition is disposed of. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
