ORDER:
The grievance of the petitioner in this writ petition is that respondent Nos.8 and 9 have encroached a public lane and that his representations dt.04.05.2015 and 26.09.2015 made to various officials of the Greater Hyderabad Municipal Corporation (GHMC), including respondent Nos.4 and 6, have not yielded any response.
At the hearing, Mr. Pasham Krishna Reddy, learned Standing Counsel for the
GHMC, submitted that his enquiry with the officials revealed that as owner of each plot in the area has moved by a few feet into the others' plots, respondent Nos.8 and 9 have evidently occupied a part of nala, and not a road. Inasmuch as the petitioner's representations stated to have been made to the above said functionaries are pending, it is appropriate that respondent No.6 considers the said representations and take remedial steps, if it is found that respondent Nos.8 and 9 have encroached either a public lane or a nala. However, before any action is taken against the said respondents, respondent No.6 shall issue notice to them and follow due procedure.
Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.46091 of 2015 shall stand disposed of as infructuous.
