THE HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15630 of 2014 ORDER:
When the matter is taken up for hearing, none appeared on behalf of the petitioner, in spite of the fact that the writ petition is listed under the caption 'for dismissal'.

Learned Standing Counsel appearing for respondent Nos.1 and 2 had contended that against the termination of the dealership of the petitioner, vide proceedings, dated 29.05.2014, the present writ petition is filed.

Learned Standing Counsel had further contended that there is a right of appeal before the Board of Directors against the orders of termination. The petitioner, without exhausting the alternative remedy, has challenged the termination orders before this Court. If the petitioner prefers an appeal against the termination of his dealership, the Board of Directors would consider the same and pass appropriate orders, in accordance with law.

This Court, having considered the submission made by the learned Standing Counsel, is of the considered view that this writ petition can be disposed of directing the petitioner to approach the Board of Directors by way of an appeal within eight weeks from the date of receipt of a copy of this order and till such time, the interim orders granted by this Court will be continued. Further, it is needless to say, the Board of Directors of the 1st respondent shall hear the
appeal preferred by the petitioner, after giving opportunity to all the parties including the 3rd respondent, and pass appropriate orders in accordance with law.

With these observations, the writ petition is disposed of. No order as to costs.
