THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Civil Revision Petition No.538 of 2016 ORDER:

After arguing for some time, Sri A.S.C.Bose, Learned Counsel for the petitioner, would submit that, since the petitioner has been carrying on business for the past 40 years, he may be granted atleast one year's time to search for an alternative accommodation, and to vacate the subject premises. Sri P. Durga Prasad, Learned Counsel for the respondents, would vehemently oppose such a request contending that the very purpose for which eviction was sought is the bonafide requirement of the son of the 2nd respondent, and any further delay in having the petitioner evicted from the premises would present insurmountable difficulties to her, more so as the petitioner is paying a measly rent at of only Rs.3,500/- per month.

Ends of justice would be met if the petitioner is permitted to continue in the subject premises for a period of six months from today on condition that he submits an affidavit of undertaking to the Court below, within two weeks from today, that he would voluntarily, and on his own accord, vacate the premises by 04.08.2016; and shall continue to pay the monthly rent of Rs.3,500/- p.m. by the 5th of the succeeding month to the respondent. Failure to furnish the affidavit of undertaking within the aforesaid period, would enable the respondents herein to take action in accordance with law for his eviction.

The Civil Revision Petition is, accordingly, disposed of. The Miscellaneous Petitions, if any pending, shall also stand disposed of. No costs. ______________________________ (RAMESH RANGANATHAN, J) Date:05.02.2016.
