THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32174 of 2015 ORDER:

The petitioner states that she was appointed on compassionate grounds in the vacancy caused by the death of her husband. She was appointed in the month of May, 2015 and a show cause notice was issued to her on 15.09.2015 alleging excess quantities in respect of PDS rice, sugar and atta. The petitioner submitted her explanation on 18.09.2015. After receiving the explanation, the authorisation of the petitioner was temporarily suspended pending enquiry by the impugned order dated 23.09.2015. Challenging the same, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that there is some excess quantity in respect of PDS rice. In respect of atta, there is no excess quantity, but it was wrongly shown that 38 kgs was less. In respect of sugar, the quantity mentioned comes within the permissible limit. However, these things have to be verified during the course of enquiry by the third respondent, and in view of the explanation offered by the petitioner, the third respondent is directed to conduct the enquiry in respect of the allegations by giving due opportunity to the petitioner and pass final orders thereon within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
