THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21926 of 2013 ORDER:
Petitioners called absent with no representation. The prayer in the writ petition is to declare the action of the respondent Nos.1 to 3 in not taking any action against the respondents 4 to 14 even there is a suicide note written by petitioner's son is available with the respondent Nos.1 to 3 and simply registering the crime No.29 of 2013 under Section 174 Cr.P.C as illegal arbitrary and consequently direct the respondent Nos.1 to 3 to take appropriate action against persons concerned basing on the suicide note.
2) It is the submission of the learned Assistant Government Pleader for Home Department that F.I.R was already registered as a case in Crime No.29 of 2013 for the offences punishable under Section 174 Cr.P.C and subsequently altered the section of law to Section 306 I.P.C against S.I. of Police and 10 others.
3) Therefore, the writ petition is closed giving liberty to the petitioner and by directing the 2nd respondent to send copy of the F.I.R and other subsequent documents viz., memo of alteration of section of law to the address of the petitioner for approaching the learned Magistrate concerned to know the progress of the investigation, as contemplated under Sections 157 and 158 of Cr.P.C, if the investigation not completed or if any final report filed so far. No order as to costs. Consequently, miscellaneous petitions, if any shall stand closed.
