HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4147 of 2015 ORDER :

The Petition is filed by the Petitioners/A.1 to A.6 under Section 482 Cr.P.C to quash the proceedings in C.C.No.2118 of 2013 on the file of the learned III Addl.Chief Metropolitan Magistrate, Hyderabad.

2) The Petitioners/A.1 to A.6 and the 1st respondent/defacto-complainant requested the Court to permit the parties to compromise the matter.

3) Both the parties present before the Court and the defacto-complainant stated the compounding is to purchase peace. Heard and perused the material on record.

4) The cognizance taken by the learned Magistrate from the chargesheet filed by the police after investigation against the accused is for the offences punishable under Sections 448,324 and 326 read with 34 of I.P.C. of which sections 324 and 326 IPC are not compoundable under Section 320 of Cr.P.C. However, another Bench of this Court by order dated 28.04.2015 permitted the parties to compound the offence under Section 326 of I.P.C.

5) By virtue of the order dated 28.04.2015 and also as both the parties stated that they wish to purchase peace and settled claims between them, the parties are permitted to compound the other offences in view of their compromise and in the interest of justice.

6) Accordingly, the petition is allowed and all the proceedings in C.C.No.2118 of 2013 on the file of the learned III Addl. Chief Metropolitan Magistrate, Hyderabad are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

7) Miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
