When the matter is taken up, written instructions dated 13.10.2018 furnished by the Sub-Inspector of Police, Narsipastnam Town Police Station, Visakhapatbnam are placed on record by the learned counsel for the petitioner.

In the said instructions, it is stated that insofar as Cr.No.24 of 2015 is concerned, the said crime was registered for the alleged offences under Sections 323 and 509 r/w 34 I.P.C. It is further stated that in the said Cr.No.24 of 2015 the Investigating Officer examined six witnesses and recorded their statements and after completion of investigation the above case was referred as "False" as per the orders of the Assistant Superintendent of Police, Narsipatnam vide C.No.171/C-4/ASP-NPM/2015 dated 16.04.2015. It is also stated that the same was served on the petitioner on 04.10.2018 and filed final report before the Court of the Additional Judicial First Class Magistrate, Narsipatnam vide DDR No.4269/18 dated 27.10.2018.

Coming to CC.No.172/2015, it is stated that Cr.No.25/2015 dated 21.02.2015 was registered on the complaint of SI of Police, Narsipatnam under Section 290 and 353 I.P.C against the first petitioner herein and after completion of the investigation the police filed charge sheet on 30.04.2015, which is presently pending vide C.C.No.172/2015, on the file of the Additional Judicial First Class Magistrate, Narsipatnam. 4.

In view of the said developments insofar as Cr.No.25/2015 is concerned, no further orders are required to be passed. So far as

C.C.No.172/2015, if the petitioners are so advised, they can file application for quashment, but not the writ petition of the present nature. Therefore, it is open for the petitioners herein to avail the remedy accordingly. 5.

With the above observations, the writ petition stands disposed of. As a sequel thereto, miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
