HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34084 of 2018 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in issuing notice vide F.Lic.No.F/158/18, dated 09.09.2018, to the petitioner to conduct survey of land admeasuring Ac.0.26 cents in Survey No.563 of Thogerchedu village, Panyam mandal, Kurnool District and not passing any order on the objections dated 13.08.2018, filed by the petitioner and also pending application dated 10.09.2018 before respondent No.2 with regard to rectification of name in the revenue records, as illegal and arbitrary. 3) The main grievance of the petitioner appears to be that respondent No.5 has no right to seek survey of the land referred to above. According to the learned counsel for the petitioner, the petitioner submitted his objections for conducting survey, but without taking into consideration the same, respondent No.4 is trying to conduct survey in respect of the above land.
4) Having regard to the above, the Writ Petition is disposed of directing respondent Nos.3 and 4 to take into consideration the objections of the petitioner, decide the issue and then proceed in accordance with law, at the earliest.
