ORAL ORDER:

Petitioners are aggrieved by their non selection as contract drivers, even though they belong to Scheduled Tribe community and participated in the selections conducted pursuant to notification dated 29.6.2016. Learned standing counsel produced the selection proceedings dated 5.11.2016 which would disclose that petitioners were declared failed in the selections conducted by them. Since petitioners are declared failed, question of holding respondents' action as illegal and issuing consequential direction to appoint petitioners, does not arise. At this stage, learned counsel for petitioner submitted that on a perusal of the instructions furnished by the learned standing counsel, it appears that selections were not properly conducted and assignment of marks was not properly made.

This would be an individual grievance and if petitioners are advised, it is open to them to avail appropriate remedy, if they are aggrieved by improper conduct of selections of contract drivers pursuant to notification dated 29.6.2016. It is also open to petitioners to apply to the competent authority of the respondent corporation to elicit information on the manner of conducting of selections. It is needless to observe that as and when such information is sought, same shall be furnished. Accordingly, writ petition is disposed of. No costs.
