This petition is filed under Section 482 Cr.P.C., challenging the order dated 09-08-2018 passed in Crl.M.P.No.2277 of 2017 in C.C.No.123 of 2017 by the Judicial Magistrate of First Class, Udayagiri, SPSR Nellore District, dismissing the petition filed under Section 317 Cr.P.C., issued NBW against the petitioner and it is pending for execution.

However, the petitioner raised several contentions in the petition, learned counsel for the petitioner, during hearing requested the Court to permit the petitioner to file appropriate application and issue a direction to the Magistrate to dispose of the application filed under Section 70(2) Cr.P.C. on the same day on appearance of the petitioner.

In view of the request made by learned counsel for the petitioner, the criminal petition is disposed of giving liberty to the petitioner to appear before the Court below and file application under Section 70(2) Cr.P.C and that the Magistrate is directed to dispose of the application filed under Section 70(2) Cr.P.C. on the same day in accordance with law.

With the above direction, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
