THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 28148 of 2015 ORDER:
Heard learned counsel for the parties.
The petitioner claims that he is the owner of plot No. 68-B in Sy.No. 71, admeasuring 350 sq. yards situated at Kondapur village, Seri Lingampally Mandal and Municipality, Ranga Reddy district. He claims to have purchased the said plot under a registered sale deed bearing pending document No. P-3979/1996, dated 12.12.1996. The petitioner now seeks to enter into an agreement of sale with third parties before the same registering authority and alleging that the third respondent is not receiving the document and processing the same, the petitioner has filed the present writ petition. The said issue was already considered by this Court in W.P.No. 17809 of 2015 and batch, dated 22.6.2015 and followed in several matters. Hence in terms of the said judgment, this writ petition is disposed of directing the 3rd respondent to receive and process the document
presented by the petitioner without insisting upon the no objection certificate to be obtained by them. The 3rd respondent is further directed to receive and process the document in accordance with the Registration Act, 1908 and Indian Stamp Act, 1899 and if the document is in conformity with the provisions, thereafter register and release the documents in accordance with the due procedure. It is also made clear that in the event of registering authority not being satisfied with the compliance under the Registration Act or the Stamp Act, appropriate refusal endorsement together with reasons shall be recorded and communicated to the petitioner in terms of Section 71 of the Registration Act. Miscellaneous applications, if any, shall stand closed. No order as to costs.
