THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.316 of 2017 JUDGMENT:

This second appeal is filed by the appellant-defendant challenging the decree and judgment dated 07.12.2016 in A.S.No.4 of 2016 on the file of Court of II Additional District Judge, Parvatipuram, wherein and whereby the decree and judgment dated 28.7.2015 in O.S.No.21 of 2011 on the file of the Court of Senior Civil Judge, Parvathipuram, dismissing the suit filed for cancellation of sale deed dated 15.2.2010 and consequential injunction, was set aside.

At the time of hearing, learned counsel for the appellant seeks permission of the court to permit the appellant to withdraw the second appeal with liberty to avail all the remedies available to her under law. Permission is granted.

This second appeal is, accordingly, dismissed as withdrawn. The miscellaneous petitions, if any, pending in this second appeal shall stand closed.
