THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR C.R.P. NO. 2156 of 2015 Date of Judgment: 19.6.2015 Between:

Smt. K. Bindu

...Petitioner

And P. Balachandra ..Respondent THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR C.R.P. NO. 2156 of 2015 ORDER:

Heard learned counsel for the petitioner.

Petitioner is the defendant in O.S.No. 90 of 2013 on the file of the Additional Senior Civil Judge, Tirupati, Chittoor district passed in I.A.No.

of dated 24.3.2015.

Apparently the petitioner/defendant contested the suit by filing written statement and at the stage of arguments, he filed the present application to send Exs.A1 and A2 to an expert for assessing the age of the signatures appearing on them. Under the impugned order the trial Court was of the view that there is no reasonable ground to allow the said

application as the suit is at the stage of final arguments and the application appears to have been filed merely to drag on the proceedings.

After hearing the learned counsel for the petitioner, I am of the view that there are no grounds to consider the request of the petitioner particularly when both sides have led evidence and the suit is at the stage of arguments. Hence the order of the trial Court is clearly justified and it does not require any interference by this Court. The revision petition is dismissed along with miscellaneous applications, if any. No order as to costs.
