THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 11300 OF 2015 ORDER:
This Writ Petition is filed to declare the action of respondent No. 1 in not considering the representation/legal notice dated 19-02-2015 complaining payment of unwarranted and ineligible amounts by respondent No. 3, represented by respondent No. 5, to respondent No. 4 by misusing public money from the funds of respondent No. 3-temple as illegal and arbitrary. 2.
The case of the petitioner is that respondent No. 4 is appointed on contract basis for a period of 11 months in the year 2008 as 'Swastivachakam' in respondent No. 3-temple and later, the said contract has been extended. Respondent No. 2 fixed the remuneration of respondent No. 4 at Rs.600/- p.m. and at present, the latter is being paid remuneration of Rs.6,000/- p.m. which is exorbitant according to the petitioner. The petitioner further submits that as he is the devotee of deity in respondent No. 3-temple, he is concerned with the abuse of power by respondent No. 5.

Learned standing counsel for respondent No. 3-temple submits that respondent No. 4 is appointed as Swastivachakam and the temple requires such a post; that the salary that is being paid to respondent No. 4 is not exorbitant and that the petitioner is a chronic litigant and filed many cases against the temple because he was refused employment in the subject temple.

Heard learned counsel for the petitioner and learned standing counsel for respondent No. 3.

As the temple is utilizing the services of Swastivachakam, the petitioner cannot complain with the payment that is being made to respondent No. 4. Even according to the petitioner, respondent No. 4 is being paid remuneration of Rs.6,000/- p.m. which cannot be said to be exorbitant in these price hiking days. Hence, the Writ Petition is liable to be dismissed. 6.
The Writ Petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
