THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7969 of 2017 ORDER:

This Writ Petition was filed challenging the action of the official respondents in interfering with the civil disputes and threatening the petitioner not to proceed with the construction in the property bearing H.Nos.1-9-5-77/1 and 1-5-77/2 admeasuring 605 square yards in survey Nos.354/1/1/1 and 354/1/3/2 situated at Bhainsa Mandal, Nirmal District.

Now counter is filed, by the 4th respondent, stating as follows:

"At the outset, it is submitted that Bhainsa Police are not interfering into the civil disputes of the petitioner herein. Bhainsa Police are also not threatening the petitioner to stop construction work in the property bearing Municipal H.No.1-5-77/1 and H.No.1-5-77/2, together admeasuring sq.yds in Sy.No.354/1/1/1 and 354/1/3/2 situated at Bhainsa Mandal, Nirmal District. It is submitted that Bhainsa Police have not received any complaint against the petitioner herein or in respect of their property from any one till today, hence question of police interfering with the petitioner's civil disputes or directing the petitioner not to proceed with the construction work in the subject property does not arise. It is submitted that Bhainsa Police are not interfering in civil disputes as alleged by the petitioner herein. The allegations to the contrary made in the affidavit are not correct and hereby denied."

In view of the above averments and in the absence of any proof of interference, this Court cannot entertain the present Writ Petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
