HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26024 OF 2016 ORDER:

The case of the petitioner is that the petitioner was issued notice dated 20.07.2016 asking him to submit to submit his objections on the application filed by the 5th respondent for mutation of his name in the revenue records in respect of the land admeasuring Ac.1.31 cents in Sy.no.207, situated in Bodangiparthi Village, Chanduru Mandal under Section 5A (1) of Andhra Pradesh Right of Records and Pattadar Pass Books Act, 1971 (for short 'the Act') before the 4th respondent. In pursuance to the same, the petitioner filed objection stating that unregistered sale deed filed by the 5th respondent cannot be validated under Section 5-A of the Act. Aggrieved by the action of the 4th respondent in entertaining the application of the 5th respondent, the present writ petition is filed.

The contentions raised by the petitioner are all factual aspects, which he can raise before the 4th respondent. Since petitioner has already filed objections, it is for the 4th respondent to consider the same before passing any orders. In view of the above, I am not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed. However, the 4th respondent shall consider the objections filed by the petitioner and also shall give an opportunity of hearing to both 5th respondent and the petitioner before passing any orders on the application filed by the 5th respondent. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
