HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 9895 of 2011 Order:
This writ petition was filed challenging the action of the respondents in reducing the 3+3 personal security officers provided to the petitioner to 2+2 personal security officers without any notice or intimation to him.
2. It is the case of the petitioner that he has been serving as Member of Legislative Assembly of Jammalamadugu Constituency for the last six years and higher grade personal security was provided to him from 2004 to 2011 and it was reduced without any notice.
3. This Writ Petition was filed in the year 2011 and no interim order was granted at that time. Subsequently, general elections were held and the State was also bifurcated. Learned Government Pleader for Home submits that the petitioner again got elected and he is being provided with 2+2 personal security officers and, if the petitioner seeks any additional security based on threat perception, it is open to him to approach the authorities concerned and they would consider the same.
4. In the light of the above facts and circumstances of the case, this Writ Petition is disposed of giving liberty to the petitioner to make a representation to the second respondent - Superintendent of Police, YSR Kadapa District, Kadapa, for any increased personal security by citing clear reasons and on making such representation the second respondent - Superintendent of Police shall consider the same in accordance with law. There shall be no order as to costs.
5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
