THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.812 OF 2017 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for respondents 1 to 5 and learned counsel appearing for sixth respondent.

This writ petition is filed challenging registration of crime No.347 of 2016 for the offence under Section 52-A of the Wakf Act, on 29.12.2016. A perusal of the complaint shows that the said crime was registered on the basis of the complaint lodged by Inspector Auditor of Wakf. The learned counsel for the petitioners submits that there are disputes between the petitioners and the sixth respondent and the civil suit ended in faovur of the petitioners. In view of the entries made in the Register of Wakfs, the sixth respondent is claiming it as a wakf property. Be that as it may, in view of the registration of the crime, this Court is not inclined to interdict the investigation. This Court already passed an order on 05.01.2017 permitting the police to proceed with the investigation without arresting the petitioners.

In the facts and circumstances of the case, this Court feels that the said order should be continued till final report/charge sheet is filed by the police concerned.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand closed. __________________________ A.RAMALINGESWARA RAO, J 24.03.2017 pln
