This writ petition is filed by the petitioner challenging the action of the respondents in not issuing a community certificate to him certifying that he belongs to Scheduled Tribe (Kammara) in terms of GO.Ms.No.58 Social Welfare (J) dated 12.5.1997 despite an application filed by the petitioner on 10.3.2014. Heard both sides.
Having regard to the facts and circumstances of this case, this Writ Petition is disposed of directing the 4th respondent, before whom the petitioner is said to have made an application as per the procedure, to consider the same in accordance with law and pass appropriate orders. In the event of any issue arising with regard to the competency of the 4th respondent to issue such a certificate, the 4th respondent shall place the same before the concerned officer and take steps to get the application decided in accordance with law.
It is made clear that the 4th respondent shall not in any event, reject the application filed by the petitioner on the ground of not being delegated with the power to issue such certificate. The above exercise shall be completed within two months from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
