HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.5370 of 2017 ORDER:

Aggrieved by the dismissal of his application for appointment of an Advocate Commissioner to record his evidence in crossexamination, the 3rd defendant has come up with the above revision.

2. Heard Mr. K.R. Sasidharan Nair, learned counsel for the petitioner.

3. The only reason stated by the petitioner in his affidavit seeking appointment of an Advocate Commissioner to examine him is that he is affected by sinus and he also had hearing disability. But these reasons are not sufficient for the appointment of an Advocate Commissioner to examine him. Therefore, the trial Court was right in dismissing the application. I find no reasons to interfere with the said order.

Hence, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
