This writ petition is filed for the following substantive relief: "...to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of Respondent No. 3 in not handing over the vehicle, bearing No. JS 200 (Proclainer) to the petitioner in spite of the Judgment in CC No. 25/12 dt.1-11-12 on the file of Judicial Magistrate First Class, Kurupam, as illegal, arbitrary, capricious, untenable and violative of Art. 14, 21 of the Constitution of India and consequently direct the respondents to handover the Proclainer, JS No.200 to the Petitioner as per the Judgment in C.C. No. 25/12 dt.1-11-12 on the file of Judicial Magistrate First Class, Kurupam." At the hearing, Mr. G. Tuhin Kumar, learned counsel for the petitioner, submitted that the cause in the writ petition does not survive for adjudication.

Hence, the writ petition is dismissed as infructuous. As a sequel to dismissal of the writ petition, W.P.M.P. No.9199 of 2013 shall stand disposed of as infructuous.
