THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.4346 OF 2015 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, to quash the proceedings in Cr.No.221 of 2015 of Women Police Station, DD, Hyderabad, registered for the offences punishable under Sections 498-A and 406 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961. Heard both sides.
A1 is the husband of respondent No.1. Petitioner Nos.1 and 2/A2 and A3 are the parents of A1. Alleging that the accused are harassing and threatening her, respondent No.1 filed a complaint before the Women Police Station, DD, Hyderabad, against the accused. Basing on the same, police registered the aforesaid crime against the accused for the offences punishable under Sections 498A and 406 I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961.
The allegations in the complaint, prima facie, reveal the commission of offences punishable under Sections 498-A and 406 of I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961 by the petitioners/A2 and A3. This is a matter, which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
Having regard to the facts and circumstances of the case, the
Criminal Petition is disposed of, directing the Investigating Agency to proceed with the investigation, however, without arresting the petitioners/A2 and A3 in connection with Cr.No.221 of 2015 of Women Police Station, DD, Hyderabad.
Miscellaneous Petitions, if any, pending in this petition shall stand closed.
