Heard the learned counsel for the petitioner and the learned Government Pleader for Excise.

The petitioner states that he holds 2B licence bearing No.03/2013-14 and has established a Bar and Restaurant at premises bearing No.14-2-192, 193, T.P.Area, Railway Station Road, Tirupati, Chittoor District. The petitioner sought renewal of the said licence by approaching the 3rd respondent vide his application, dated 1004-2015. According to the petitioner, previously his Bar and Restaurant was located in Ward No.15 of Tirupati Municipal Corporation. It is stated that Tirupati Municipal Corporation had taken up delimitation exercise and now there are 50 divisions and ward numbers. Consequent thereupon, Ward No.15 now falls under Ward No.26. The petitioner states that the said ward is not a prohibited ward and as such, the application for renewal can be considered.

The grievance of the petitioner, however, is that for the excise year 2014-15, the 3rd respondent had passed an order, dated 26-03-2014 intimating the petitioner about ban on liquor sales on approach roads to the entry points to the Tirumala Hills and therefore, the petitioner was asked to shift the Bar from the existing location to another suitable premises.

Learned Senior counsel for the petitioner, however, states that in view of delimitation and newly carried out wards, the petitioner's application needs to be considered in the light of the subsequent events on merits afresh. Learned Government Pleader submits that if the petitioner's application is pending, the same would be appropriately considered and appropriate orders would be passed.

In the circumstances, therefore, the writ petition is disposed of directing the 3rd respondent to consider the petitioner's application aforesaid in the light of the

existing policy guidelines and the rules and all other relevant material and take appropriate decision in the matter and communicate the same to the petitioner expeditiously. No order as to costs.
