HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CIVIL REVISION PETITION No.109 OF 2017 ORDER:
This Civil Revision Petition, under Article 227 of the Constitution of India, is preferred by the petitioners-plaintiffs aggrieved by the inaction of the Principal Junior Civil Judge, Srikalahasti, in not passing any orders in I.A.No.1586 of 2016 in I.A.No.766 of 2010 in O.S.No.269 of 2010.
Heard the learned counsel for the petitioners. Since this Court is not going into merits of the case, it may not be necessary to issue notice to the respondents. Though the present CRP is filed questioning the delay in disposal of I.A.No.1586 of 2016 in I.A.No.766 of 2010 in O.S.No.269 of 2010 on the file of the Principal Junior Civil Judge, Srikalahasti, the learned counsel for the petitioners, on instructions, would submit that his counterpart before the lower Court will not press I.A.No.1586 of 2016 filed to re-open I.A.No.766 of 2010, but however, seeks a direction to the trial Court for an early disposal of O.S.No.269 of 2010.
Having regard to the submissions made by the learned counsel for the petitioners that I.A.No.1586 of 2016 filed seeking to re-open I.A.No.766 of 2010 will not be pressed by the petitioners before the trial Court and as the main suit, which is of the year 2010, is now posted for further evidence of defendants, the trial Court is directed to dispose of O.S.No.269 of 2010 as early as
possible preferably within a period of ten weeks from the date of receipt of a copy of this order, in accordance with law. Accordingly, the Civil Revision Petition is disposed of. No order as to costs. Miscellaneous petitions pending in this petition, if any, shall stand closed.
