HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.36225 OF 2016 ORDER:

The writ petition is filed questioning the action of the of the 2nd respondent in trying to demolish the house bearing Door No.258, Sy.No.312/P, Christianpally, Mahabubnagar Town, Mahabubnagar District without following the due process of law.

Heard the learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Sri N. Praveen Kumar, learned standing counsel for the 2nd respondent.

It is the case of the petitioner that he is the owner of the house Plot bearing No.258, Sy.No.312/P, Christianpally, Mahabubnagar Town, Mahabubnagar District. Subsequently, the petitioner got permission to construct the house and accordingly constructed house in the above said plot. It is stated that after construction of the house, on 25.01.2016, the petitioner applied for Building Regulating Scheme by paying the penalty fee and the same is pending for consideration. The petitioner had also applied for L.R.S on 02.03.2016 and the same is also pending.

Considering the fact that the petitioner has applied for B.R.S and the same is pending with the respondents-authorities, the writ petition is disposed directing the respondents-authorities to dispose of the application dated 25.01.2016 of the petitioner within a period of eight weeks from the date of receipt of copy of this order in accordance with law. However, till such time, the orders are passed on the B.R.S application of the petitioner, there shall not be any demolitions subject to condition of the petitioner continuing to pay the property tax as assessed.

With the above observations, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
