Heard the learned counsel for the petitioner and the learned Government Pleader.
Petitioner was appointed as Dealer Shop No.42 of Modavalasa village, Denkada Mandal, Vizianagaram District. While so, the 5th respondent inspected the shop on 15-5-2017 and found that shop was closed. After coming to know about the visit, she came to the shop. But, however, a panchanama was conducted on 16-5-2017 and the stock was seized. Though the variation was marginal, the Assistant Supply Officer, Vizianagaram submitted a report on 18-5-2017 and basing on the same, the authorization of the petitioner was suspended by proceedings dated 19-5-2017. Challenging it, the present Writ Petition is filed. The said order of suspension is pending enquiry. There are five irregularities noticed during the course of inspection apart from the variation in the stock.
Since the enquiry is pending before the third respondent, this court is not inclined to go into the merits of the case at this stage. It is open to the petitioner to submit her explanation to the charges leveled against the petitioner and the 3rd respondent shall complete the enquiry, after giving due opportunity to the petitioner, within a period of two months from the date of receipt of a copy of this order.
Accordingly, this Writ Petition is disposed of. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
