THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.31845 OF 2013 O R D E R :

Heard counsel for the petitioner and the Government Pleader for Revenue appearing for respondents.

Petitioner's grievance is that the respondents 1 to 4 are not taking action in regard to the complaint dt.03.06.2013 made by him under the A.P. WALT Act, 2002 in regard to digging of a bore well by respondents 5 and 6 abutting to his land without obtaining any permission under the said Act.

Counsel for the petitioner contends that the petitioner again reiterated the said complaint on 03.05.2013 through a representation addressed to the District Collector and on 28.05.2013 through a representation to the Deputy Director, Ground Water Department, Guntur, but no action has been taken by the said officials.

It is the mandatory duty of respondents 1 and 2 to ensure the implementation of the provisions of A.P. WALT Act, 2002 and after acknowledging the receipt of complaint from the petitioner, they cannot remain idle and do nothing in the matter. 5.

Therefore, this Writ Petition is disposed of directing the respondents 1 and 2 to forthwith initiate proceedings to enquire into the allegation made by the petitioner against respondents 5 and 6 under the provisions of the said Act, and after giving opportunity to respondents 5 and 6 pass orders and communicate the same to the petitioner. This exercise shall be completed within

a period of eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 6.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
