HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1952 OF 2016 ORDER:
The writ petition is filed challenging the action of the respondents in not considering the cases of the petitioners under Debt Waiver Scheme during 2014-15.
Heard the learned counsel for the petitioner and the learned Government Pleader for Agriculture.
Petitioners claiming that they are the agriculturists and they are eligible for Crop Waivers Scheme, 2014-15. The communication dated 5.5.2015, issued by the 4th respondent-Assistant Director (Agriculture), Adilabad to the 3rd respondent-Joint Director of Agriculture informing that about 222 farmers crop loans cannot be sanctioned as they are not covered under the Debt Waivers Scheme, 2014-15 and the 4th respondent had also recommended that the small and marginal farmers may be extended for the benefit of Debt Waivers Scheme, 2014-15. The grievance of the petitioners is that even though the 4th respondent-Assistant Director (Agriculture), Adilabad had recommended on 5.5.2015 to the 3rd respondent-Joint Director of Agriculture, Adilabad, no action is taken so far. Hence, the writ petition.
Learned Government Pleader for Agriculture, on instructions, submits that the petitioners are not eligible for loan waivers scheme, 2014-15 as their loans have been converted into long term loans. Having heard both the learned counsel for the petitioners and the learned Government Pleader for Agriculture, I am not inclined to enter into the controversy as to whether the petitioners are eligible for loan waivers scheme, 2014-15 as the petitioners would be satisfied if a decision is taken by the 3rd respondent-Joint Director (Agriculture) on the communication dated 5.5.2015 of the 4th respondent-Assistant Director (Agriculture).
In the facts and circumstances of the case, the interest of justice would be served if the writ petition is disposed by giving a direction to the 3rd respondent-Joint Director (Agriculture) to communicate the decision taken by him on the recommendation dated 5.5.2015 of the 4th respondent-Assistant Director (Agriculture) about the eligibility or otherwise of the petitioners for Loan Waivers Scheme, 2014-15. Accordingly, the writ petition is disposed of directing the 3rd respondent-Joint Director (Agriculture) to communicate the decision taken by him on the recommendation dated 5.5.2015 of the 4th respondent-Assistant Director (Agriculture) about the eligibility or otherwise of the petitioners for Loan Waivers Scheme, 2014-15. No order as to costs.
Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
