THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.1444 of 2011 ORDER:
Petitioners challenge fixation of cut off marks for consideration to the post of 'Shramiks' vide notification No.R3/684(23)/2010-HRD dated 01.11.2010.
At the time of admitting the writ petition, no interim order was granted by this Court. As fairly submitted by the learned counsel, the selection is finalized and appointment orders were also issued. However, learned counsel sought to contend that even though 841 vacancies were notified, only 355 vacancies were filled up. The aspect that there was no justification to fill few vacancies as against large number of vacancies notified cannot be gone into at this stage since the petitioners were not selected. Selection already made cannot be nullified as the candidates selected are not parties before this Court. Thus, no relief as sought for in the writ petition can be granted. However, the issues raised in this writ are left open to be agitated in appropriate proceedings. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed.
