Heard learned counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration appearing for the respondents.

This Court, having considered the matter on merits on 30.01.2023, expressed a view that there is no legal basis for respondent No.3 to refuse to receive the document that is sought to be presented by the petitioner herein for registration and granted liberty to the petitioner to present the subject document for registration.

Today when the matter is taken up for consideration, it is represented by learned counsel for the petitioner that in terms of the order passed by this Court on 30.01.2023, the petitioner presented the document in respect of the subject property for registration and the same is already processed for registration and is released in favour of the petitioner. Hence, the major grievance of the petitioner stands redressed. However, it is contended by learned counsel for the petitioner that even after registering and releasing the document in favour of the
petitioner, still the subject property is continued in the prohibitory properties list on the web site of respondent No.3 herein. As already noted above, this Court does not find any basis to include the subject property in the prohibitory properties list. In the absence of any restraint order restraining alienation of the subject property, the action of the respondent No.3 in including the subject property in the prohibitory properties list is without any authority and jurisdiction. 4.
In the light of the above, it is expected that respondent No.3 shall take immediate steps for deleting the subject property from the list of prohibitory properties, as there is no restraint order by any competent Court restraining alienation of the subject property.

The writ petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
