HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION Nos. 38805 and 38806 of 2016 COMMON ORDER:
Heard the learned counsel for the petitioner and Government Pleader for Revenue and, with their consent, the writ petition is disposed of at the admission stage. The action of the respondents, in seeking to demolish the houses of the petitioners and evict from their respective properties situated adjacent to Gundlakamma Canal, Saibaba Nagar, Atmakur, Kurnool District, is questioned in this Writ Petition as being illegal and arbitrary.
The petitioners claim to have constructed houses adjacent to Gundlakamma canal long back as per the plan sanctioned by the Atmakur Gram Panchayat. It is their grievance that the staff of respondent Nos.2 and 3 visited the subject land on 06.11.2016, and informed that their houses would be demolished for the purpose of widening the Gundlakamma canal. Aggrieved thereby, the present Writ Petition.
Learned Government Pleader for Revenue (Andhra and Rayalaseema) states that any action, which the respondents would take, either to evict or demolish the houses of the petitioners would only be in accordance with law.
In the circumstances, I consider it appropriate, therefore, to dispose of the Writ Petition directing the respondents not to take coercive steps to dispossess the petitioners from the houses in question except in accordance with law.
The Writ Petitions are, accordingly, disposed of. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
