Singamaneni Lakshminarayana v. The State Of Andhra Pradesh,

2017-07-07S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V.BHATT W.P. No.21769 OF 2017 ORDER:

The petitioners pray for the following relief: "...WRIT OF MANDAMUS declare that the action of the respondents No.2 to 5 in non supplying of the registered Sale Deed document bearing No.P12 dated 15-05-2017 is illegal, arbitrary, violation of procedure and direct the respondents No.2 to 5 to supply the copy of registered sale deed document No.P12 dated.15-05-2017 by making all entries in the Revenue records under the custody of 5th respondent including 1-B-Form pertaining to the land in Sy.No.178/4A, Ac.1-98 cents situated in Chilakapadu village of Santhanuthalapadu Mandal, Prakasham District..."

On 04.07.2017, on the request of respondents, the writ petition has been adjourned to today to enable the counsel to get instructions from respondents 3 and 4. The written instructions dated 05.07.2017 received form the office of 3rd respondent are placed on record. According to the Assistant Government Pleader, the registration of document was sought under 'Anywhere Registration Programme'. The document was presented before the 4th respondent who has forwarded the document to 3rd respondent for completing the process of registration. Now, the 3rd respondent states that having regard to the entries in revenue records, the 3rd respondent declined to complete the process of registration and has returned online to respondent No.4 Therefore, there is no

document registered either by 3rd respondent or 4th respondent to return the original or give copy of registration extract of sale deed. I have perused the material available on record and taken note of the submissions of learned counsel.

The writ petition has been filed on the premise that the registration is completed, but document is not returned. In view of the stand of 3rd respondent, this Court is of the view that the 4th respondent is under obligation to communicate the endorsement on document No.P12 to petitioner to enable the petitioner to work out the remedy in accordance with law.

The writ petition is dismissed with the above observation. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date:07.07.2017 Stp
