HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7583 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.4 to 10 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.218 of 2014 of Chinthakani Police Station, Khammam District registered for the offences punishable under Sections 498-A, 506 and 313 of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act.

2) Heard the learned counsel for the petitioners and the 2nd respondent-State represented by the Public Prosecutor before admission, before ordering notice to the 1st respondent and perused the material on record.

3) A perusal of the record shows the facts fall short for this Court that too by the investigation is in progress to admit the application to stay the investigation, but for to say the factual matrix entitled to the concession of bail to the petitioners.

4) Having regard to the above, the Criminal Petition is disposed of giving liberty to surrender before the learned Magistrate and move for regular bail with notice to the A.P.P concerned and in such an event, the learned Magistrate shall grant bail with necessary conditions. Needless to say the learned Magistrate can dispense with the presence of

the petitioners at post bail stage. Further remedies, if any, to the petitioners after filing final report and after taking cognizance by the learned Magistrate, are left open.

5) Consequently, the miscellaneous petitions, if any pending, shall stand closed.
