THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34164 OF 2018 ORDER :

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development and Sri S.Lakshminarayana Reddy, learned Standing Counsel for GVMC, apart from perusing the entire material available on record.

When the matter is taken up, it is brought to the notice of this Court that the GVMC issued a notice, under Section 452 of the Hyderabad Municipal Corporation Act, 1955 on 25.05.2018. A perusal of the material available on record discloses that, in response to the said show cause notice, dated 25.08.2018, petitioner herein submitted an explanation on 05.09.2018 (acknowledged by the GVMC on 10.09.2018).

It is submitted by the learned Standing Counsel that the respondent-GVMC will consider the said explanation and pass appropriate orders, strictly in accordance with law. Recording the above submission, Writ Petition is disposed of, directing the respondent-GVMC to consider the explanation, dated 05.09.2018 (acknowledged by the GVMC on 10.09.2018), submitted by the petitioner herein in response to the show cause notice, dated 25.08.2018, and take further action/pass

appropriate orders, strictly in accordance with law. Till the said exercise attains finality, there shall no coercive action against the subject constructions. It is also made clear that no further construction shall be made. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
