Shrib. Hari Prasad v. State Of Ts
HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.35260 OF 2018 ORDER:
Heard Sri B. Vijaysen Reddy, learned counsel for the petitioners, and the learned Advocate General appearing for the respondents. With their consent, the Writ Petition is being disposed of at the admission stage itself.
2.
The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the 2nd respondent in not passing any order in the stay petition filed along with the revision as illegal and arbitrary and consequently, stay the operation of the order, dated 02.08.2016.
3.
Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the 2nd respondent to dispose of the stay petition or the revision, as the case may be, in view of the fact that the respondent authorities are constructing two bed room houses under a scheme, in the subject land.
4.
The learned Advocate General representing the State of Telangana would submit that out of Ac.17-00 of land, construction is going on in Ac.7-00 of land.
5.
Having regard to the above, except in the area where the construction is going on, the respondent authorities shall maintain status quo in respect of the other portion of the subject land till orders are passed in the main revision. It is needless to mention that the 2nd respondent shall dispose of the revision petition as early as
possible, preferably within a period of three (3) to six (6) months from the date of receipt of a copy of this order.
6.
Accordingly, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _______________________________ JUSTICE C.PRAVEEN KUMAR October 11, 2018.
