P.Naveen Kumar Reddy, v. The State Of Andhra Pradesh,
The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.38082 of 2015 Dated 24.11.2015 Between:
P.Naveen Kumar Reddy ... Petitioner and The State of Andhra Pradesh rep. by its Special Chief Secretary HM & FW Dept., Hyderabad and 3 others.
...Respondents
Counsel for the petitioner: Mr.T.Nagarjuna Reddy Counsel for respondent No.1: GP for General Administration (AP) Counsel for respondent No.2: AGP for Finance & Planning (AP) Counsel for respondent No.3: AGP for Medical Health & Family Welfare (AP) The Court made the following:
O r d e r :
This Writ Petition is filed for a Mandamus to declare the proposed action of respondent No.4 in funding erection of a statue in the campus of Sri Venkateswara Institute of Medical Sciences, Tirupathi, as illegal and arbitrary. At the hearing, Mr.A.K.Jaya Prakash Rao, learned Standing Counsel appearing for respondent No.4- Tirumala Tirupati Devasthanam, submitted that he was specifically instructed to report to the Court that respondent No.4 is not spending any part of its funds either towards the cost of the statue or towards the expenditure required for such erection. As the petitioner's concern is mainly related to the purported proposal of respondent No.4 to spend its funds towards erection of statue in its campus, his concern has been properly addressed and his grievance stands redressed with the unequivocal statement made by the learned Standing Counsel for respondent No.4 that the latter's funds are not being spent.
With the above observations, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, WPMP.No.49009 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
