HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 2867 OF 2017 ORDER:

This Writ Petition was filed challenging the action of the respondents 2 to 4 in interfering with the civil dispute, in respect of the property, which is the subject matter of O.S.No. 97 of 2015, on the file of Principal Junior Civil Judge, Sattupalli, and harassing the petitioner to compromise with the 5th respondent.

A Counter affidavit is filed by the respondents 2 and 3 stating that on the complaint of the 5th respondent, a Crime No. 285 of 2016 was registered and charge sheet was also filed on 14.12.2016.

However, with regard to the other allegations of harassment and forcing him to compromise with the 5th respondent, it is stated as follows: "It is submitted that the allegation of the petitioner that the 5th respondent who is the friend of the 4th respondent who is presently working as Tahsildar, Sathupally Mandal and at his instance the 4th respondent has influenced the 2nd and 3rd respondents and at his instance this respondent has false registered two cases against him when the civil suit is pending and further at the instance of the 4th respondent, this respondent has been calling him regularly to the police station and has been forcing him and harassing him to withdraw the suit and also gave an undertaking that he should be interfere with the possession and enjoyment of the 5th respondent and on 24.12.

2016 this respondent has called him to the police station and forcibly taken an undertaking from him and also manhandled him is absolutely false, baseless and exaggerated and hence the same is denied. In this regard, I submit that on the compliant of the 5th respondent herein, the above mentioned case was registered against the petitioner, his wife and conducted the investigation as contemplated under law and filed appropriate charge sheet before the concerned Hon'ble Court. For the purpose of investigation, the investigation officer enquired the matter with the petitioner but it does not mean this respondent police are interfering with the civil disputes. I humbly submit that this respondent at any point of time, summoned the petitioner to this respondent office or obtain any alleged undertaking from him.

In view of the same, no further orders are necessary in this Writ Petition and accordingly, the Writ Petition is closed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
