HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 40396 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Sri Vedula Venkataramana, learned Senior Counsel for the petitioner and Sri Y. Ravindra for the 1st respondent. The order under challenge in the instant writ petition reads thus: "The complainant is present. None present on behalf of the Ashok Gardens Function Hall. It is stated by the complainant that interim orders passed by the A.P. High Court on 30.10.2015 lapsed by 06.11.2015 and thereafter there is no continuation of interim orders by the A.P. High Court. In the circumstances, issue summons to Konijeti Ashok Kumar, Proprietor, M/s. Ashok Gardens Function hall, to be present before this institution on 15.12.2015 for hearing."
Sri Vedula Venkataramana, learned Senior Counsel for the petitioner, submits that the order passed by the Lokayukta is without jurisdiction apart from the fact that it is passed on the assumption that the interim order passed by the High Court on 30.10.2015 lapsed on 06.11.2015. He submits, the interim order passed by the High Court operates till today. If that be so, it is always open for the petitioner to invite attention of learned Lokayukta to the order, whereby interim order, dated 30.10.2015, continued and operates till today. Even the issue of jurisdiction can also be raised before the Lokayukta. We do not find any adverse order as such passed against the petitioner. By the impugned order the Lokayukta has simply directed the petitioner to remain present before it on 15.12.2015 for hearing. Hence, the writ petition is dismissed. All contentions on merits are kept open to be raised before the Lokayukta on the next date of hearing.
