HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No. 3 4 3 6 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, KPHB PS, Cyberabad Commissionarate, dated 29.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "On receipt of a private complaint filed by the petitioner herein under Section 200 Cr.P.C., before the Hon'ble Court of XIX Metropolitan Magistrate, RR District at Kukatpally, a case in Cr.No.804/ 2017 under Sections 406, 409, 415, 418, 429, 506 r/ w 34 I.P.C., and Section (3) Cr.P.C., dated 22.06.2017 was registered on the file of KPHB Police Station against Mr.K.V.Ramaraju and 15 others and taken up the investigation into the case.

During the course of investigation, the investigation officer examined the complainant/ petitioner and recorded his detailed statement. Notice under Section 91/ 160 Cr.P.C., was also issued to the petitioner/ complainant requesting to produce the relevant documentary evidence and also to produce the cited witnesses. A letter, dated 14.12.2017, was addressed to the Sub-Registration Officer, Kukatpally, requesting him to furnish attested copies of document Nos.3316/ 2016, 104/ 2017, 1616/ 2017, 1535/ 2017, 1536/ 2017 for the purpose of investigation into the case.

A letter, dated 11.01.2018 was addressed to the Branch Manager, Central Bank, JNTU, KPHB, requesting to furnish the transactions details of the

WP.34367/2018 AVSS,J A/ c.No.347339935 from 01.02.2016 to 01.06.2017 to enable the investigating agency to proceed with further investigation into the case.

The investigation is pending for want of examination of some more witnesses including the cited witnesses of the complainant/ petitioner and to collect some more documentary evidence to establish the offences mentioned in the FIR.

To complete the ful-fledged investigation into the case, it requires some more time to the investigating agency.

It is pertinent to submit that the averments made in the affidavit are the subject matter of investigation in Cr.No.804/ 2017, for which, a detailed investigation is under progress. The investigation is pending for want of examination of cited witnesses of the complainant and also for collection of material evidence to establish the offences. I assure to this Hon'ble Court that the investigation will be completed as expeditiously as possible and an appropriate report will be filed before the concerned Hon'ble Court at the earliest.

It is humbly submitted that due to administrative reasons i.e., change of SHOs from the Hyderabad to Cyberabad Commissionarate, some delay has cause in completing the investigation into the above case and the delay is neither willful nor wanton."

Accordingly, the Writ Petition is disposed of by placing on record the said instructions furnished by the Sub-Inspector of Police, KPHB PS, Cyberabad Commissionarate, dated 29.10.2018, with a further direction to the respondent-police authorities to complete the investigation, as expeditiously as possible, and file a final report.
