HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Contempt Case No. 2507 of 2015 Order:

This Contempt Case is filed alleging non-implementation of the order, dated 25.08.2014, passed in W.P. No.1736 of 2010, wherein this Court directed the respondent herein to issue notices to all the flat owners/tax payers of Siripuram Towers, within a period of four weeks from the date of receipt of a copy of the order, as they were not issued notices earlier.

2. Now, a counter affidavit is filed stating that pursuant to the said orders, notices to all the flat owners were issued on 03.12.2014 and explanations were sought. All the flat owners/tax payers of Siripuram Towers have submitted their explanations.

Considering the explanations submitted by them, the revised building permission issued on 21.10.1988 was revoked. It was also stated in paragraph '9' of the counter that suppressing the above facts, the petitioner has filed the present contempt case.

3. In view of the explanation submitted by the respondent in the counter, this Court feels that no contempt is made out and the Contempt Case is, accordingly, closed.

However, in the circumstances, no costs.
