THE HONOURABLE SRI JUSTICE RAJA ELANGO COMPANY PETITION No.252 OF 2015 ORDER:

This Company Petition is filed under Sections 433(e), (f), 434(1)(a) and 439 of the Companies Act, 1956 read with Rule 95 of the Company (Court) Rules, 1959 seeking the following relief: "a) M/s.Brahma Teja Paper Products (India) Pvt.Ltd., Having its Registered Office at Survey Nos.230 & 232, Turkayamjal, Kammaguda village, Hayathnagar mandal, Rangareddy District-501 510 and others the respondents wound up in accordance with the provisions of the Companies Act, 1956 and b) to appoint Official Liquidator as provisional liquidator pending the disposal of the winding up petition under Sec.450 of the Companies Act 1956, and to pass such other order or orders as are deemed fit and proper in the circumstances of the case."

When the matter is taken up for hearing, it is informed by the learned counsel for the petitioner that notice sent to respondent No.1 was returned unserved on the ground that the addressee left and the petitioner also informed him that the respondent company is not in existence.

Recording the submission of the learned counsel for the petitioner, this Court is of the view that no purpose would be served in keeping this Company Petition pending. 4.

Accordingly, this Company Petition is dismissed. There shall be no order as to costs.

Miscellaneous Applications pending, if any, in this Company Petition shall stand closed.
