THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26052 of 2016 ORDER:

The petitioner is working as a Field Assistant. He was appointed on 11.01.2010 to the Kogileru Village, Peddapanjani Mandal in Chittoor District under the Mahatma Gandhi National Rural Employment Guarantee scheme. While so, it appears that one J.Sulochana and two others gave a complaint on 05.12.2014 and basing on the said complaint, the petitioner was kept out of contractual employment temporarily by proceedings dated 02.02.2015. The petitioner submitted a representation on 26.03.2015 to the Mandal Development Officer requesting her to vacate the suspension order. But, the third respondent, by proceedings dated 20.02.2016, permanently kept him out of employment with immediate effect and directed him to remit the misutilised amount of Rs.29,850/- while intimating that he can file an appeal within thirty days before the second respondent.

Against the said order, the petitioner submitted an appeal before the second respondent on 05.03.2016 and when the same was not disposed of, the present Writ Petition is filed. Since the Writ Petition is only for disposal of the appeal pending before the second respondent, this Court feels it not necessary to keep the Writ Petition pending, but disposes of the Writ Petition with a direction to the second respondent to consider and dispose of the appeal preferred by the petitioner on 05.03.2016 against the order of the third respondent dated 20.02.2016, within a period of eight weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
