HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.30136 of 2015 ORDER:

Heard.

Aggrieved by the order, dated 19-12-2014 passed by the 3rd respondent, the petitioner has filed ROR Appeal No.6 of 2015 along with stay application and the same is pending before the 2nd respondent since 08-012015. The petitioner questions inaction on the part of the 2nd respondent, as according to him, no date is fixed and neither the appeal nor stay application is taken up for hearing.

Since the grievance of the petitioner in this writ petition is only with regard to hearing and disposal of the appeal or at atleast stay application, I deem it appropriate to direct the 2nd respondent to fix an early date of hearing, preferably within one week from the date of receipt of a copy of this order and atleast pass appropriate orders in the stay petition filed by the petitioner in the said appeal and thereafter, hear the parties and decide the appeal on merits, expeditiously.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 16-09-2015 Prv
