ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.158 of 2025 before the Mahankali Police

Station, Hyderabad, registered for the offence punishable under Sections 376(1), 417, 420, 504 and 506 of IPC. 2.

The brief facts of the case are that the victim had stated that she came into contact with the petitioner, Gari Ganti Vamshi Krishna, through matrimonial websites in 2023 and that he proposed marriage after frequent communication. Believing his assurance, she met him at Secunderabad on 06.05.2024, where he allegedly forced her into a hotel and committed sexual intercourse with her on the promise of marriage. Thereafter, he allegedly avoided her, demanded further physical relations, blocked her on social media, and later informed her that he could not marry her. She further stated that he abused her, threatened her, and finally sent his wedding card showing his marriage to another woman. After discussing the matter with her family, she approached the police and lodged the present complaint alleging cheating, sexual exploitation on the pretext of marriage, and threats. 3.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated and that the allegations were baseless, unsupported by independent evidence, and based solely on the statement of the complainant. He submitted that the petitioner, a serving Army employee, would suffer irreparable harm if arrested and placed in judicial custody. He contended that the investigation had not produced any material showing the petitioner's involvement in the alleged offences. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious and heinous in nature. He further submitted that the statement under Section 183 of BNSS was already recorded. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the petitioner and the victim have been in a relationship since 2024. Furthermore, even after receiving information about the petitioner's marriage, the de facto complainant did not lodge a complaint with the Police. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Mahankali Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
