ORDER

This application is filed seeking to relax condition imposed by this Court on 03.10.2018 and modified on O2.04.2019 to appear before Station House Officer, concerned, once in a month on every first Sunday, between 5,0O PM to 06,00 PM till the end of trial, instead of 'on every Wednesday and Sunday till filing of the charge sheet and thereafter, once in a month on l"t Sunday till completion of trial/enquiry between 05.00 PM to 06.00PM.

The petitioner is A.15 in Crime No,171 of 2013 pending on the file of Kanagal Police Station. The offences alleged against the petitioner are under sections 420 and 109 IPC and Sections 4 and 6 read with (c) 3 of the Prize Chits and Money Circulation Scheme (Banning Act), 1978 and Section 58(3) of RBI Act, 1934 and 1s5(3) of Cr.P.C.

Learned Public Prosecutor, on instructions would submit that the investigation is still pending and charge sheet has to be filed. He further submits that there is no allegation against the petitioner with regard to the allegation of violation of any of the conditions imposed by this Court. Considering the said aspects, this application is allowed relaxing the condition to appear before Station House Officer, concerned, once in a month on every first Sunday, between 5.0O PM to 06.0O PM till the end of trial, instead of 'on every Wednesday and Sunday till filing of the charge sheet and thereafter, once in a month on l"t Sunday till completion of trial/enquiry between O5.O0 PM to 06.00 PM. However, it is made clear that other conditions imposed in the order remain unaltered, The petitioner shall cooperate with the Investigating Officer by appearing before him as and when his presence is required, sd/- B.
