HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10161 of 2018 ORDER :

Heard.

So far as the offence under Section 420 IPC or the lesser one under Section 417 or 418 IPC, as the case may be, defined under Section 415 IPC, concerned, but for to say there is no any entrustment or criminal breach of trust to attract the offence under Section 406 IPC.

Having regard to the above, the criminal petition is partly allowed by quashing the crime registered for the offence under Section 406 IPC and police are directed to complete the investigation and file the final report, preferably within two months. 4.

Accordingly, the criminal petition is allowed in part. Learned Magistrate, pursuant to the bail order of the petitioners/A.1 to A.7, shall not insist their presence pending investigation, but for to summon after police final report if at all taken cognizance or other than to implement the bail conditions if at all in force.
