THE HON'BLE SRI JUSTICE SANJAY KUMAR and THE HON'BLE SMT JUSTICE ANIS APPEAL SUIT No.368 of 2011 JUDGMENT: (per SK, J) Memo of withdrawal dated 28.11.2016 was filed by Sri Pushyam Kiran, learned counsel for the sole appellant/plaintiff, seeking leave to withdraw this first appeal filed against the judgment and decree dated 04.10.2010 passed by the learned IV Additional District Judge, East Godavari, Kakinada, in O.S.No.14 of 2005. The ground for seeking such withdrawal was stated to be the fact that the matter was settled out of Court under Deed of Settlement dated 21.06.2016. In the light of the aforestated facts, the appeal is dismissed as withdrawn.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
