Heard Ms.K.Hemalatha for petitioners.
The petitioners challenge notice dated 28.04.2012 issued by 6th respondent on several legal and factual objections. On 26.06.2012, this Court granted interim direction restraining respondents from interfering with petitioners' possession and enjoyment of Sy.Nos.46/ 1, 46/ 2, 46/ 3, 47/ 3 & 45/ 2 of Billapadu Gram Panchayat, Gudivada, Krishna District.
Respondent Nos.6 and 7have filed counter affidavit. Ms.Hemaltha, keeping in view the objections raised in the counteraffidavit and also that a few steps were taken for conversion of subject land from agriculture to non-agriculture, restricts her prayer to permit petitioners to submit explanation to respondent Nos. 6 and 7 within four weeks from today.
The writ petition is, accordingly, disposed of by this order: a) the petitioners are given liberty to represent to respondent Nos.6 and 7 by enclosing a copy of this order;
b) respondent Nos.6 and 7 are directed to consider the explanation, afford opportunity to petitioners and pass orders as expeditiously as possible, preferably within three months from the date of receipt of explanation; and c) till a decision is taken and communicated to petitioners, the interim order granted by this Court is directed to be maintained.
There shall be no order as to costs.
