HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11472 of 2012 ORDER:

1. This writ petition was filed challenging the registration of Crime No.16 of 2012 on the file of Hindupur Rural Police Station, Anantapur District.

Though no counter-affidavit is filed, on the basis of the written instructions submitted to him, the learned Government Pleader for Home states that on the complaint of the 4th respondent, a case in Crime No.16 of 2012 was registered against the petitioners for the offences under Sections 323, 447, 506 I.P.C. and Section 3 (1) (X) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, by the Sub Inspector of Police, Hindupur Rural Police Station, Anantapur District. During the course of investigation, 17 witnesses were examined and their statements were recorded. A prima facie case was made out against the petitioners. In view of the order of this Court dated 20.04.2012 directing continuance of investigation without arresting the petitioners, the respondent-police have completed the investigation and filed charge sheet before the Judicial Magistrate of First Class, Hindupur, on 29.01.2014.

3. In view of filing of the charge sheet, this Court is not inclined to examine the relief sought for by the petitioners. However, since the petitioners were not arrested pursuant to the orders of this Court dated 20.04.2012, the arrest of the petitioners shall not be made without getting orders from the competent Court.
